By accessing or using DeerStats ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. DeerStats is operated by Kendall Drake ("we," "us," or "our").
2. Description of Service
DeerStats is a hunting analytics tool that allows users to upload trail camera photos, analyze historical weather and moon phase data, and generate PDF reports with hunting forecasts. The Service is intended for personal, non-commercial use by hunters.
3. No Guarantee of Hunting Success
DeerStats provides data-driven insights and forecasts based on patterns found in your uploaded photos and publicly available weather data. We make no guarantee, warranty, or representation that use of the Service will result in successful hunting outcomes. Deer behavior is influenced by many variables beyond weather and moon phase. The Service is a tool to inform your decisions, not a guarantee of results.
4. User Accounts
You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when creating your account. You must be at least 18 years old to use the Service.
5. Payments and Subscriptions
DeerStats offers pay-per-report purchases and monthly subscription plans. All payments are processed securely through Stripe. Subscription fees are billed monthly and will automatically renew unless cancelled. You may cancel your subscription at any time through your account settings. Refunds are provided at our sole discretion. If you believe you were charged in error, contact us within 7 days at the email below.
6. Your Content
You retain ownership of all photos and content you upload to DeerStats. By uploading content, you grant us a limited license to store and process your photos solely for the purpose of providing the Service to you. We do not sell, share, or use your photos for any other purpose. You are responsible for ensuring you have the right to upload any content you submit.
7. Prohibited Uses
You agree not to: (a) use the Service for any unlawful purpose; (b) upload content that infringes on the rights of others; (c) attempt to reverse engineer, hack, or disrupt the Service; (d) share your account with others; (e) use automated tools to access or scrape the Service.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEERSTATS AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
10. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website. Your continued use of the Service after changes take effect constitutes your acceptance of the new Terms.
11. Governing Law
These Terms shall be governed by the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Florida.
